TRNC House purchase law TR and other countries.

The acquisition of immovable property by foreign nationals in the Turkish Republic of Northern Cyprus (TRNC) is carried out within the framework of Law No. 52/2008 on the Acquisition of Immovable Property and Long-Term Leasing (Foreigners), Amendment Law No. 39/2024, and related Decrees Having the Force of Law published in the Official Gazette.

Legal regulations introduce significant differences in rights and limits between citizens of the Republic of Turkey (TR) and citizens of other foreign countries.

1. Basic Purchase Limits

In the legislation, persons acquiring property are divided into two categories: "Citizens of countries recognizing the TRNC and applying reciprocity (TR)" and "Citizens of Other Foreign Countries":

  • Citizens of the Republic of Turkey:
  • Can acquire a maximum of 6 apartment units or 3 detached villas within a mass housing/site.
  • Broader land acquisition permits are foreseen for large-scale investors who meet certain conditions (such as a commitment to a minimum investment amount in tourism, technology, industry, etc.).
  • Citizens of Other Countries (Third Country Nationals):
  • Can acquire a maximum of 3 apartment units or 2 villas in approved site projects.
  • In the purchase of empty land, a right to a maximum of 1 donum (1,338 m² – with the condition of building a single residence on it) or a detached residence with land of maximum 3,300 m² is granted.

  • Mandatory Council of Ministers Permission: Everyone who is not a TRNC citizen (including TR citizens) must undergo an investigation by the TRNC Ministry of Interior and obtain Immovable Property Purchase Permit (PTP) from the Council of Ministers to complete the title deed transfer (koçan transfer). The koçan transfer cannot be registered without the permit.
  • Prohibited Areas: Agricultural lands, forest areas, and military/security zones are closed to acquisition by foreigners.
  • Project Quotas: In developed housing projects, a maximum of 80% of the units can be sold to foreigners; at least 20% must be reserved for TRNC citizens or citizens of countries based on reciprocity (TR).
  • Trustee Agreements: Foreigners are prohibited from accumulating immovable property through secret agreements in the name of TRNC citizens to exceed legal quotas; a legal notification and liquidation requirement has been introduced for such past agreements.

3. Known Uncertainties and Risks to Consider

  1. Uncertainty of Permit Processes: The completion time for Council of Ministers permits can be prolonged depending on bureaucratic and security investigations; there is no legal guarantee that every application will be approved.
  2. Title Deed Types and Legal Status: Immovable properties in the TRNC have different ownership histories such as Turkish Title Deed (Türk Koçanı), Equivalent Title Deed (Eşdeğer Koçan), and Allotment Title Deed (Tahsis Koçan). Due to international law, property disputes, and Immovable Property Commission processes, it is critically important for the land registry to be examined by an expert lawyer.
  3. Legislative Changes and Preclusive Periods: Decrees Having the Force of Law introduce specific periods for the registration of sales contracts with the Land Registry Office, payment of taxes and fees, and registration of ownership. Non-compliance with these periods may lead to contracts being deemed invalid or to punitive fees.
